1. Definitions

Capitalised terms mean:

• HornySpot — the brand, software, and infrastructure we operate (web, mobile, APIs).
• Platform — the surfaces where accounts are created and the product is used.
• User — anyone who loads our pages, logged in or not.
• Member — a user who finished signup and can reach member areas.
• Content — text, images, audio, video, links, or live streams you upload or stream.
• Services — discovery, messaging, moderation, payments, analytics, and related tools we ship.
• Premium — paid add-ons layered on the free core.

2. Agreement

Consent

Using the Services means you accept these Terms, our Privacy Policy, and the cookie choices you make. If any clause is unacceptable, discontinue use.

Updates

We post revisions here. Where the law allows, ongoing use after a change can count as acceptance.

3. Eligibility

Your responsibility

• Be responsible for activity under your account
• Report suspected misuse quickly
• Log out on shared devices

One account

One active account per person. Multiple accounts may lead to restrictions.

Verification

We may request additional proof for identity, age, and anti-fraud purposes.

5. Conduct

Permitted use

Use the Services only for lawful purposes in accordance with these Terms.

Prohibited conduct

• Harassment, threats, intimidation
• Hate speech or discrimination
• Impersonation or misleading identity/age
• Unauthorized commercial advertising
• Sharing personal data without consent
• Illegal activity
• Bypassing safety controls
• Automated/unauthorized access

Real people

No fake profiles. No misleading use of photos or identity. No accounts for third parties.

Respect & consent

Interactions must be consensual, respectful, and lawful.

6. Content & rights

Your content

You retain rights to your uploads. By uploading, you grant us a worldwide, non-exclusive, royalty-free license to host, display, process technically, and improve the Services.

• Display on the platform
• Sharing with other users where applicable
• Technical processing required to operate
• Operating and improving the Services

Standards

• Sexual content involving minors
• Non-consensual intimate media
• Violence or illegal activity glorification
• Hate or discrimination
• Spam or unauthorized promotion
• Infringement of other people’s rights

Moderation

We may review, remove content, restrict accounts, and notify authorities when required.

Brands

Trademarks and branding of HornySpot may not be used without written permission.

7. Premium & payment

Premium features

• Enhanced likes/matches
• Additional filters
• Read receipts
• Incognito mode
• Priority support

Subscription

• Ongoing billing (depending on plan)
• Auto-renewal until cancellation
• Non-transferable
• Access while your subscription is active

Payment processing

Handled by certified providers. We do not store full card details.

Cancellation & refunds

Cancel in your account settings. Refunds follow applicable store/provider rules and legal requirements.

Price changes

Price updates with reasonable advance notice (e.g., 30 days) where required.

8. Termination

By you

Delete your account in settings; deletion is permanent.

By us

We may restrict or terminate access in cases such as:

• Violation of these Terms
• Illegal or harmful behavior
• Fraud or deception
• Safety risk
• Extended inactivity

Effects

• Usage rights end
• No further access
• Data deletion or anonymization as described in the Privacy Policy
• Existing claims remain unaffected

9. Disclaimer / warranty

As-is

The Services are provided “as is” and “as available”. To the extent permitted by law, we disclaim warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy of content
• Uninterrupted or error-free operation

Between users

We do not guarantee safety between users and do not verify every profile in full.

Third parties

We are not responsible for linked sites, off-platform behavior, or outcomes of private meetings.

10. Liability limits

Exclusions

To the extent permitted by law, we are not liable for:

• Indirect or consequential damages
• Lost profits
• Loss of data
• Non-material damages
• Damages arising from user interactions

Cap

Total liability is limited to the higher of amounts paid in the last 12 months or a minimum threshold permitted by law.

Mandatory law

Nothing in these Terms limits liability that cannot legally be excluded.

Indemnity

You indemnify HornySpot against claims arising from your use, violations of these Terms, or rights of third parties.

11. Law & dispute resolution

Governing law

To the extent permitted by law, the laws of the Federal Republic of Germany apply, excluding conflict-of-law rules.

Disputes

Disputes are primarily resolved amicably where possible. Mandatory consumer jurisdiction rules remain unaffected.

Class / representative actions

Where legally permitted, you waive class or representative proceedings.

Limitation periods

Claims must be asserted within the statutory limitation periods.

Severability

If any provision is invalid, it does not affect the remaining provisions.
